Cooltourspain, represented as CTS in this document, states that:
Customer assumes sole responsibility to independently confirm all documentation requirements for all passport, Photo IDs and/or printed/electronic tickets. Customer(s) assumes sole responsibility for, and hereby releases CTS from any claims or responsibilities for any damages incurred as a result of customer(s) failure to comply with applicable documentation requirements at all times.
CTS accepts Visa, Paypal, International Bank transfers (fees to be covered by customer’s bank) and cash. CTS holds all reservations processed by the booking date/activity date. If payment is not received by CTS on or before the booking/ payment date, reservations are automatically cancelled. Without limitation, customer(s) voluntarily hold CTS harmless for cancellation of any booking for either late payment or declination of a credit/debit card.
Prices and availability quoted by CTS are subject to change. Pricing and availability may change without notice. Passenger agrees that CTS is not responsible for any errors or omissions in any quotes, advertisements, including, not limited to our website or flyers/posters, resulting in inventory, content, or pricing discrepancies, nor is CTS responsible for any errors or omissions that may occur as a result of incorrect information from third parties. CTS reserves the right to charge customer(s) for any increase in taxes, fees or surcharges (i.e. transportation). Customer(s) acknowledge this right, and agree to pay any such additional taxes, fees, and surcharge.
It may happen that certain activities referred to in our website or any other media are no longer provided. Climatic reasons, events of force majeure, a stay out of the tourist season, or when the minimum number of participants required for providing a given activity is not reached are few samples of what could lead to a cancellation. In the early or late season some activities may not be available, some of the facilities (restaurant, swimming pool, etc.) may be closed, or maintenance work may be in progress. As a general rule, entertainment and sports activities may vary in frequency depending on how many people are staying at the time and on climatic conditions. The opening hours of bars, restaurants, and clubs, etc., may be irregular and dependent on the management of the establishment in question. You agree that CTS is not liable for activities unavailable due to any reason, not limiting to the ones mentioned above.
Maximum waiting time for any of the activities offered by CTS will be 10 minutes after the stated official departure time. Neither reimbursement nor compensation will be offered to customers in any case scenario.
The number of stars attributed to the hotels and other providers of accommodation quoted by CTS correspond to a classification established as a point of reference in accordance with local standards in the host country. Accommodation will be in 2, 3, and/or 4 star hotels depending on availability, and may not include breakfast. We reserve the right, for technical reasons, in cases of force majeure or actions by third parties, to replace the planned hotel with accommodation of the same category offering equivalent services. This would only be in exceptional circumstances and in such cases we will inform you as soon as we are aware of this necessity.
6-. Cancellation policies
All cancellations must be in writing and sent to CTS by email to firstname.lastname@example.org Cancellations sent to any other addresses will not be processed. Upon making the booking, customer(s) hereby accept & acknowledge liability for all cancellation fees imposed by CTS and/or any supplier. Cancellations are posted on the day that the complete cancellation documents are received by CTS so long as they are received before 5:00 p.m. GMT Time on business days. All other cancellations will be posted on the next business day.
Activities/road trips organized by CTS must be cancelled exclusively by the person who made the payment up to 7 days before the time the activity takes place. Copy of the ID/ passport, credit/debit card must be sent to email@example.com
7-. Limitation of liability
Without limitation, customer(s) assume the risk of, and agree that CTS is not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints of any government or rulers of people, piracy, war, revolution, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collision, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases, local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks or other waters, perils of navigation of any kind, theft, accident to or from machinery, boilers, or latent defects even though existing at commencement of the trip, desertion or revolt of crew, or lost/damaged/delayed luggage.
You agree to defend and indemnify Cooltourspain and all of their respective officers, directors, employees and agents from and against any claims, causes of action, demands, suits, proceedings, investigations, losses, damages, fines, penalties, fees, expenses, costs and any other liabilities of any kind or nature including but not limited to reasonable legal and accounting fees, arising out of or related to:
- 1. your breach of this Agreement or the documents referenced herein;
- 2. your violation of any law, rule, regulation or guideline;
- 3. your violation, infringement or misappropriation of the rights of a third party, including without limitation any rights of publicity or privacy;
- 4. your use of this Website;
- 5. your booking or use of any Products obtained through this Website; or
- 6. your negligence or willful misconduct.
8-. Cooltourspain Vouchers/coupons
You may receive a personalized CTS voucher/coupon (“Voucher”) for some of the events we organize. In order to redeem your CTS Voucher(s) at any of the activities offered you must provide the original, authentic CTS Voucher to the appropriate tour leader. For security purposes, when redeeming your CTS Voucher you must present a valid Photo ID/ passport and sign any required documentation. This is for identification purposes and helps us to prevent fraud.
In some cases CTS also requires that you present the credit/debit card used to purchase your tour or ticket at the time of redemption. This generally applies only to attraction and show tickets. This helps us to prevent credit-card misuse. Any changes or amendments will be made at CTSs sole discretion.
Please note that your CTS Voucher(s) can be confiscated – and immediately canceled without refund – if your signature and/or name do not match those shown on either your credit or debit card or coupon.
